ChatGPT / OpenAI widget on a site: notice required
A ChatGPT embed is never “obviously human”. The notice must appear as soon as the visitor opens the assistant.
ChatKit embeds, custom GPTs or openai.com/embed iframes speak like an agent. Article 50(1) is exactly this case: tell people they are talking to AI, at the latest at the first interaction.
A “ChatGPT” watermark in a corner, or OpenAI’s terms, do not replace a clear sentence on your page, in your language. The visitor is talking to your site, not to the vendor’s docs.
Record the embed (model, FAQ/support use) in the register. Machine-readable marking of generated content elsewhere on the site is a separate topic (transition until 2 December 2026 for some systems).
